1. Agreement to Terms
By accessing or using WorkSwipe ("the Service"), operated by Questo ("we", "us", "our"), you agree to these Terms of Service. These terms apply to both employer and candidate accounts. If using the Service on behalf of an organization, you represent authority to bind that organization.
2. Description of Service
WorkSwipe is an AI-powered hiring platform that matches employers with job candidates through a mutual-interest swipe interface. The Service includes AI candidate scoring, job posting, match management, calendar integration, and analytics.
3. Account Types
Employer accounts require a paid subscription to post jobs and access matched candidates. Candidate accounts are free and always will be. Both account types must provide accurate information during registration.
4. Subscription and Payment (Employers)
- Pricing - Plans start at $149/month (Starter) and $299/month (Professional). Enterprise pricing is custom.
- Billing - Subscriptions are billed monthly in advance. We accept credit cards and ACH via Stripe.
- Free trial - New employer accounts receive a 14-day free trial with Professional features. No credit card required.
- No per-hire fees - All plans include unlimited hires at the flat monthly rate.
5. Cancellation
Starter and Professional plans are month-to-month with no cancellation fees. Cancel from your dashboard at any time. Cancellation takes effect at the end of the current billing period. Candidate accounts can be deleted at any time from account settings.
6. Acceptable Use - Employers
- Post only genuine, active job opportunities
- Do not use the platform for data harvesting or resume scraping
- Do not discriminate based on protected characteristics in hiring decisions
- Respect candidate privacy and visibility settings
- Do not share candidate information outside your authorized hiring team
7. Acceptable Use - Candidates
- Provide truthful and accurate profile information
- Do not create multiple accounts or impersonate another person
- Do not use the messaging system for spam, harassment, or solicitation
- Do not scrape employer information from the platform
8. AI Matching Disclaimer
WorkSwipe uses AI to generate match scores and recommendations. AI matching is a tool to assist hiring decisions, not a replacement for human judgment. We do not guarantee employment outcomes. The AI does not use protected characteristics as matching factors. We regularly audit our algorithms for bias.
9. Intellectual Property
You retain ownership of content you upload (resumes, job descriptions, company profiles). By uploading content, you grant us a limited license to process, display, and transmit it as needed to operate the Service. We retain ownership of the WorkSwipe platform, AI models, and all proprietary technology.
10. Data Portability
Employers may export their job postings, match history, and analytics data at any time. Candidates may export their profile, match history, and messages. Export is available through account settings or by request to support@questo.media.
11. Service Availability
We target 99.9% monthly uptime. Scheduled maintenance is announced at least 48 hours in advance. We are not liable for downtime caused by factors outside our control including internet outages, third-party service failures, or force majeure events.
12. Limitation of Liability
Questo's total liability shall not exceed fees paid by you in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages. We are not responsible for hiring decisions, employment outcomes, or employer-candidate interactions that occur outside the platform.
13. Termination
We may suspend or terminate accounts that violate these terms, engage in fraudulent activity, or abuse the platform. We will provide notice and an opportunity to cure when feasible. Account data is available for export for 90 days after termination.
14. Governing Law
These terms are governed by the laws of the State of Israel. Disputes shall be resolved in the competent courts of Tel Aviv-Jaffa, Israel.
